It was 9 o’clock on a cold autumn morning. Like most days, after dropping my kids off at school, I went to the usual bar for my second coffee of the day. The other mothers had not been able to stay. Being alone, my mind immediately went to the problems of my marriage. Although my decision to end the relationship was final, all the paperwork, the lawyers, the court was a world away.And that’s what I was doing when I suddenly overheard two parents who, like me, were having coffee after dropping off their children. One of them told the other about family mediation as a voluntary and peaceful way of resolving the breakup of the couple, which had many advantages and was being successfully practiced in several Spanish autonomous communities. And immediately those words caught my attention and I concentrated on listening to their conversation.<\/p>\n\n

The speaker, who was in his forties, conveyed confidence, and told his companion that, although he was a lawyer, he was convinced that mediation was good for couples because the agreements that they are obliged by law to reach are negotiated between them, “no one knows more about their own lives than they do”. I said that the mediator is a neutral and impartial professional whose main function is to facilitate communication, respect and the necessary balance between the couple so that they can negotiate the best possible agreements, those in which both they and their children win, without anyone losing or giving in. I couldn’t believe it, it was the perfect solution for my situation, if true.<\/p>\n\n

As soon as I got home I turned on my laptop, went on the internet and typed in the words “Family Mediation” into Google. And a new world appeared before my eyes. There were countless pages to enter, both from Spain and the rest of the world.<\/p>\n\n

As far as I understood, mediation is a confidential process that takes place in several sessions of approximately one and a half hours (one per week) that are held in the mediator’s professional office, and is regulated by law. The agreement reached by the parties is set forth in a document, the “Mediation Agreement”. which will serve as a regulatory agreement in the lawsuit that is subsequently filed in court, since the homologation of the agreements by the judge is mandatory.And above all, the most interesting thing I read was that the mediation process, compared to other ways of resolving conflicts, has many advantages: it saves time (it takes less than two months), saves money (it avoids future expenses), is effective (85% of the agreements are fulfilled), is flexible (it adapts to the circumstances of the parties), preserves privacy (it is confidential), reduces hostility between the parties (it stops the escalation of the conflict) and improves their self-esteem (they learn to negotiate).I will talk to my husband. We have to go to mediation. We need a peaceful future.<\/p>\n\n
